SC again stops Goa mining from 16 March, orders fresh ECs & recover dues

In an order issued today morning, the apex court has said no mining lease would function from 16th March.
They have to now obtain fresh environment clearance – not renewals – for the leases.
The central ministry for environment and forests has been directed to complete the process as fast as possible.
But According to Dr Claude Alvares, Director of Goa Foundation who had filed the special leave petition in this regard, this process would take at least two to three years.
“They should have done it when the ban was lifted”, he said.
Goa Govt told to recover dues
In the same order, the Supreme Court has also directed Goa government to expedite the recovery of the due amounts from the mining lease holders who have been found guilty.
The apex court has said Goa government should initiate this action based on the reports prepared by the team of Chartered Accountants, the Special Investigation Team of Goa police as well as other available reports.
Following is the operative part of the order:
The mining lease holders who have been granted the second renewal in violation of the decision and directions of this Court in Goa Foundation are given time to manage their affairs and may continue their mining operations till 15th March, 2018.
However, they are directed to stop all mining operations with effect from 16th March, 2018 until fresh mining leases (not fresh renewals or other renewals) are granted and fresh environmental clearances are granted.
The State of Goa should take all necessary steps to grant fresh mining leases in accordance with the provisions of the Mines and Minerals (Development and Regulation) Act, 1957. The Ministry of Environment and Forest should also take all necessary steps to grant fresh environmental clearances to those who are successful in obtaining fresh mining leases.
The exercise should be completed by the State of Goa and the Ministry of Environment and Forest as early as reasonably practicable.
The State of Goa will take all necessary steps to ensure that the Special Investigation Team and the team of Chartered Accountants constituted pursuant to the Goa Grant of Mining Leases Policy 2014 give their report at the earliest and the State of Goa should implement the reports at the earliest, unless there are very good reasons for rejecting them
.The State of Goa will take all necessary steps to expedite recovery of the amounts said to be due from the mining lease holders pursuant to the show cause notices issued to them and pursuant to other reports available with the State of Goa including the report of Special Investigation Team and the team of Chartered Accountants.
The writ petitions and SLPs are disposed of in accordance with the above conclusions and directions.

Initiate Recovery process immediately.
Start distribution of recovery amount to the Mining Dependant and non-Mining dependant.
Pass a Law, which will allow restarting of Mining only after fully recovered of One Lakh Corers Rupees.
FIRST = RECOVERY. SECOND = DISTRIBUTION. THIRD = AUCTIONING
Auctioning must be Third.
First must be recovery of 98 Thousand Crores.
Distribution of the recovery amount to the Mining Affected and to the non-Mining affected must be the Second.

HONEST GOANS should file case on Congress and recover Rs.1 Lakh Corers Rupees and distribute the recovered money among the Mining dependent and non-Mining dependent and balance money should invest in Education, Health, Water & Electricity.
